Erika Kirk leaves court abruptly as witnesses give graphic evidence about husband

Erika Kirk rushed out of court after a police officer who responded to husband Charlie’s murder scene testified about the chaos that unfolded in the moments after he was fatally shot.

Former Utah Valley University police officer Chris Bagley began describing the moment he heard the gunshot that killed Kirk as he testified for the prosecution at alleged killer Tyler Robinson’s preliminary hearing.

Kirk’s widow Erika, who had wept at the start of the hearing, was not able to sit through the details of the testimony and abruptly left the courtroom.

The five-day preliminary hearing is the first time members of Kirk’s family are in the courtroom with alleged assassin Robinson.

Prosecutors are seeking the death penalty against Robinson and will argue that he should stand trial for murder.

Robinson is charged with aggravated murder in the September 10 assassination of Kirk, who was shot dead while addressing a crowd of thousands during a Turning Point USA event at Utah Valley University.

The accused killer turned himself in after the shooting and prosecutors allege that he also sent a text message confession to his partner.

He has not entered a plea in the case. His attorneys have not commented on his guilt or innocence.

Kirk’s mother Kathryn had her head bowed and Erika Kirk leaned on a friend for comfort as the testimony was delivered.

Former State Bureau of Investigation agent describes leading Charlie Kirk investigation

David Hull, a a former Utah State Bureau of Investigation agent, told the courtroom how he was not familiar with Charlie Kirk or Utah Valley University at the time that he was asked to lead the investigation.

Prosecution calls next witness to the stand

Defense attorney Kathryn Nester finished cross-examining former Utah Valley police officer Chris Bagley shortly after the court’s lunch break.

Nester grilled Bagley with several questions about how the gunman could have been identified. ‘Nothing that you found that day,’ Nester asked, ‘was able to identify who the shooter was?’

She also asked Bagley about his body camera footage following the incident. After Bagley looked on the roof of the Losee building, he said he did not find any bullet casings, and that his body camera footage stopped recording.

‘I think my battery died. I don’t know,’ he said, confirming that he did not return to the roof once his body camera was charged because it was a chaotic scene.

Following Bagley’s testimony, the state called David Hull to the stand, a police officer who works for the Utah Department of Public Safety.

Hull was an investigator with the State Bureau of Investigation’s major crimes unit at the time of Charlie Kirk’s death.

Officer Chris Bagley described hearing a gunshot on Utah Valley University campus

Bagley described the moments of chaos after Charlie Kirk was shot.

He said he could see the right side of Kirk as the conservative activist spoke on campus on September 10.

Kirk was in the middle of answering a question when the officer heard a gunshot ring out. He saw people fleeing the area before police confirmed that they had had a suspect in custody over the radio.

Bagley began assessing the crowd for injuries as he worked to ‘preserve the crime scene.’

Bagley confirmed there was a clear ‘line of sight’ from where Kirk was sat to the top of the Losee Center where Tyler Robinson allegedly fired his rifle.
